On Compiling

I can't find the right part of the forum to post this, so please forgive me if I do have posted it here, as I am also a beginner in this forum.

So anyway, I just have this one quick question that was not discussed in the FAQ of the forum.

Let's say I used the Danmakufu Engine (PH3) in making my own Touhou game or rather, Touhou style game with my original characters, so this means no Reimu, Sakuya or anything like that. Purely characters that I've built myself, but I am still attached to the engine and used all mechanics and all relating to Danmakufu, would I run to legal issues if I used Danmakufu?

Also, is there a way to compile a standalone project of my Touhou game? Similar as to what others or how it was done here?

Or is Danmakufu Ph3 really open source?

Thank you very much in advance for all the answers!
